ANY PERSON WHO DOES NOT ACCEPT THESE GENERAL TERMS AND CONDITIONS, WHICH ARE MANDATORY AND BINDING, MUST REFRAIN FROM USING THE SITE AND/OR THE SERVICES.

The User must read, understand and accept all the conditions established in the General Terms and Conditions and in the Information Privacy and Confidentiality Policy, as well as in the other documents incorporated therein by reference, prior to their registration as a User of Real Estate Portal.

1. Scope of services

These services were born to respond to the growing need to incorporate sales tools and technology in the management of real estate sales, thus offering support software for the management of sales of professional users (hereinafter, the “Software” or the ” Services”).

It is made clear that Real Estate Portal is not related, directly or indirectly, to any developer or construction company, property broker, bank, economic group or union institution that could generate certain restrictions to the content or produce distortions in the objectivity of its presentation.

2. Relationship with the published offer information

Real Estate Portal does not offer the published properties, is not the owner, does not participate in any way in the business of renting or selling the properties and does not receive commission for the transactions carried out, whether the Offeror is an individual or a property broker.

In the case of the projects, Portal Inmobiliario does not own them, it does not intervene in the design, construction, commercial management or in any other way that links it beyond being a means of publication on the Internet. The published information is the exclusive responsibility of the companies that expose it through the services offered by Real Estate Portal.

Real Estate Portal does not assume any obligation to store the data, content and images of offers published on the site and that have been withdrawn.

3. Levels of interaction with Real Estate Portal


3.1. Classification

There are different levels of connection with Real Estate Portal, from the most basic to the most complex.

3.1.1. visitors
It is any user who accesses one or more pages of information published in the Real Estate Portal, not requiring their identification or registration for said access (hereinafter, “Visitor”). However, the mere browsing of the site subjects this visitor to certain restrictions and conditions that are analyzed and reported in greater detail later.

3.1.2. Registered user
It is that Visitor who incorporates their data in a registration form to access services, which by their nature, require the identification and prior registration indicated above (hereinafter, “Registered User”).

3.1.3. Offeror User
It is that Registered User who makes use of the Real Estate Portal to offer a property under the modality of sale, rent or temporary rent (hereinafter, “Offer User” or the “Offer”)

3.1.4. Customer User
Is that Registered User, whether or not he is a Offering User, who pays for any service in this category, whether he does so as a natural person, or on behalf of a legal person (hereinafter, “Client User” or “Customer”). ”).

The scope, limitations and conditions that will be analyzed below for the services of a more elementary level of interaction are understood to form part of the scope, limitations and conditions of the level that succeeds it in complexity.

4. General Conditions of the support services for the management of Real Estate sales

The Services are only available to persons who have the legal capacity to contract. People who do not have that capacity, minors or Users of the Real Estate Portal who have been temporarily suspended or permanently disabled will not be able to use the services. If you are registering a User as a Company, you must have the capacity to contract on behalf of such entity and to bind it in the terms of this Agreement.

Real Estate Portal is not responsible nor is it obliged to verify the accuracy, veracity or reliability of the information that is incorporated by Users on the Real Estate Portal Website or websites that share information with Real Estate Portal. Real Estate Portal will not be responsible or guarantee the security of any information including but not limited to credit cards and any other personal information that is provided by the visitor, registered user, offeror and/or client to the Portal or websites that share information with Portal real estate

Visitors, Registered Users, Offerors and Clients waive and agree to release from all liability, as well as to initiate any legal action against Real Estate Portal derived from any controversy that arises between them and Real Estate Portal or websites included in Real Estate Portal.

Visitors, Registered Users, Offerors and Clients undertake to comply with applicable federal, state or municipal laws as well as with these Policies and any other document linked to the Real Estate Portal, including but not limited to the Terms and General Conditions of Use of Real Estate Portal.

Visitors, Registered Users, Offerors and Clients undertake to release Portal Inmobiliario, its directors, employees, shareholders, subsidiaries, affiliates, agents and licensors from any damage that Portal Inmobiliario could suffer, due to the incorrect use of the services or for the breach of any of the Policies described here. Likewise, the Visitors, Registered Users, Offerors and Clients agree to reimburse Real Estate Portal for any expense or disbursement made for said concepts, including expenses and/or attorneys’ fees.

These Policies will be governed and interpreted in accordance with the laws of the Mexican Republic. For the interpretation and fulfillment of these, the parties submit to the jurisdiction of the courts of common law in the Federal District, renouncing from this moment any other jurisdiction that may correspond to them according to their present or future domiciles.

5. Modification of the Agreement

Real Estate Portal is not obliged, beyond the publication on the site, to inform and/or communicate directly the changes in its services every time they occur, be they modifications, additions or subtractions to them. Likewise, Real Estate Portal is not obliged to report in the event of the incorporation of new services or the elimination of an existing one. However, Real Estate Portal will make the necessary efforts so that the information that is delivered is the most up-to-date possible.

6. Information Privacy

To use the Services offered by Real Estate Portal, Users must provide certain personal data. Your personal information is processed and stored on servers or magnetic media that maintain high standards of security and both physical and technological protection. 7. Reserved Rights

The information published at the request of Real Estate Portal tools cannot be used in whole or in part by a visitor, registered user, offeror or client on other sites through non-convenient links or by any other means, without the prior authorization of Real Estate Portal.

The graphic material in which there has been incorporation of design or modifications by Real Estate Portal, may only be used on said site, unless expressly authorized by Real Estate Portal.

Real Estate Portal, as well as its software, are registered as a trademark and protected under copyright, prohibiting its unauthorized use, and its total or partial reproduction by any means.

8. Scope, limitations and conditions of services for Visiting Users

The services for Visiting Users constitute the information presentation service for new and used properties, made up of free access pages.

8.1. scope of service


Real Estate Portal does not own or have any interference in the marketing of the properties published on the Website. Real Estate Portal does not know the properties or attributes, characteristics or other conditions beyond what is published on the site, therefore the verification of the data published by the Bidders is not part of the service offered. Action that, otherwise, would be practically impossible given the number of properties, the nature of the information and the dynamism of the publications and updates.

Thus, Real Estate Portal does not guarantee the quality of the service offered by those who sell or rent their property, nor does it constitute a guarantor of the commitments of one or both parties. Nor does it assume any responsibility for the quality of the properties, nor for the damages that the defects and characteristics of its design or construction could mean for any person. Likewise, Real Estate Portal does not assume any responsibility for any inconvenience or economic or moral damage that could be caused by a completed, ongoing or failed business, generated from a property or other product published on the site.

8.2. Reliability level of the information presented
8.2.1. Regarding the data
Real Estate Portal has invested considerable resources in the development of a site that meets the best quality standards in presentation, response speed and security. Likewise, it has developed modern tools that allow the constant monitoring and detection of errors in the published information, and for those cases in which automated detection is not possible, it has developed an exhaustive review and customer service guideline, minimizing shortcomings as much as possible. in the published information. Reviewing and updating the information, so that it is highly reliable, is a constant and essential concern for Portal Inmobiliario.

However, this important purpose makes it impossible for us to guarantee the total absence of errors or omissions in the information presented, as a result of the fact that the Offeror User is ultimately responsible for the published data. These, for the most part, take special care in the information they publish. However, the large number of them, and in many cases, the large number of properties that each seller handles, makes it impossible to ensure that there are no errors, outdated, impressions or simply data that does not match reality.

In relation to what is indicated in the previous point, Real Estate Portal does not guarantee that the information published by third parties on the site is entirely free of errors, that it does not present misleading or openly false data, nor is it outdated, or data that is inconsistent with that delivered in the point of sale, especially in relation to prices (“from” “to”) and surfaces, in the case of properties.

8.2.2. Regarding the images
The published images are provided by the Bidders, for this reason, Real Estate Portal does not guarantee that the published images associated with the properties are representative of them, are free of retouches that distort reality or, when appropriate, have the rights that authorize their publication. . Portal Inmobiliario does not assume any responsibility towards third parties in the event that the publication of the images in Portal Inmobiliario is not representative of the properties or they do not have the corresponding authorization.

8.2.3. Regarding the description and attributes of a publication
Real Estate Portal does not guarantee that the descriptive texts of the properties or developments are strictly true to reality, include non-existent attributes, are free of omissions, exaggerations or deliberate inaccuracies, made in order to generate greater interest in the recipient.

8.2.4. Regarding the promotions
Unless expressly stated otherwise, Real Estate Portal does not organize or have any interference in the promotions offered through its website. These have been developed and organized exclusively by the Bidders, being their sole responsibility to comply with the promotional terms. Likewise, Real Estate Portal does not guarantee that events published as promotions represent more favorable conditions than the usual ones for that project, or property. Nor does it guarantee compliance by the company or individual Bidder. Real Estate Portal is not responsible in the event that the respective company refuses to comply with what is offered in the promotion.

8.2.5. Regarding the location
Real Estate Portal does not guarantee that the location provided by the Bidder corresponds exactly to reality. Similarly, if there is a map provided by the Bidder, it is not guaranteed that, being a reference, it does not distort distances, in order to favor a better valuation of the location.

8.2.6. Regarding availability
Real Estate Portal does not guarantee that the properties published as available are actually available.

8.2.7. Regarding financing conditions
Real Estate Portal does not guarantee that the information related to the financing of the property that the Offeror could advertise, is duly valid at the time of being received by the Visitor.

8.2.8. Regarding the update of the information
Even when Real Estate Portal, as indicated in point 7.2.1, undertakes the best efforts to improve updating standards, and the information has been exposed by the Bidder with special care to represent reality, it cannot be guaranteed that said information be fully up to date.

8.3. Scope regarding the legal and commercial validity of the published data
Consistent with what is indicated in points 1.2, it is expressly warned that it will be the full responsibility of the Visitor to initiate any type of action that could generate inconveniences, problems, waste of time or money based on the information of a property published in the Real Estate Portal, without prior verification with the respective Bidder, especially with regard to price and availability. In this way, the information published through the Real Estate Portal, especially in relation to prices and forms of payment, do not have legal and/or commercial validity from the point of view that a Visitor can demand that a certain business be carried out carried out from data published on the Real Estate Portal, unless the Bidder expressly indicates otherwise together with the data of a property. In said event, the responsibility for the fulfillment of said promise will fall exclusively on the Bidder. Therefore, Real Estate Portal has no responsibility for data, information, promises, terms or other conditions offered by companies, individuals or any third party.

Likewise, Real Estate Portal is not the guarantor of the commitments that may be entered into between the Visitor and the Offeror. In this sense, Portal Inmobiliario does not assume any responsibility for the inconveniences and/or damages that may occur due to or on the occasion of a closed, ongoing or failed business generated from information published in Portal Inmobiliario, especially in cases where that a payment has been made by the Visitor.

9. Scope, limitations and conditions of services for Registered Users

They may have access to the services intended for registered Users, all those natural persons who, on their own behalf or on behalf of a legal person, register as users (“Registered User”) for which they must complete the registration form in all its fields with valid data to be able to use the services provided by Real Estate Portal. The future registered user must complete it with their personal information in an exact, precise and true manner (“Personal Data”) and assumes the commitment to update the Personal Data as necessary. Real Estate Portal may use various means to identify its Users, but Real Estate Portal is not responsible for the accuracy of the Personal Data provided by its registered users. They guarantee and are responsible, in any case, for the veracity, accuracy, validity and authenticity of the Personal Data entered.

Portal Inmobiliario reserves the right to reject any application for registration or to cancel a previously accepted registration, without being obliged to communicate or explain the reasons for its decision and without this generating any right to compensation or compensation.

It will be a condition of registration, knowing and accepting the Scope, Limitations and Conditions of Services Destined to Visiting Users of the Real Estate Portal (Pto.8).

9.1. Scope of services

The need for identification is based on the very nature of the service (personalized services) and on the control of access to resources and/or more detailed information (controlled services).

9.1.1. Customized services

They are those services that, being oriented to a specific recipient, require the user’s identification data for their satisfaction.

9.1.2. controlled services

They are those services that require user identification data, since a control similar to that required at the point of sale is necessary.

9.2. Use of services

The user can freely use the services enabled for him when he deems it convenient, not being obliged to use each one of them. By the mere fact of using the services, the user declares to know and accept the conditions and scope of each of them.

The user, by the mere fact of using and accepting the services, authorizes Real Estate Portal and/or its linked websites to process the personal data registered on said site, in particular with regard to storage, recording, ordering, interconnection and transmission of this data. The treatment of personal data in no case implies the transfer or sale of the data registered by the user.

9.3. Exclusion of services and disabling

In the case of services that by their nature are not anticipated and that are executed by an action of the user requesting it, as is the case of emails, the user is given the possibility, at the time of registration, to freely exclude it. Likewise, later instances of disabling are offered.

9.4. Use of identification data

Our website does not collect or capture personal data automatically, the only ones that are collected are those that users provide when registering or communicating with us through the website.

9.4.1. Data not shared

The identification data of users who use services whose nature does not require them to be shared with third parties, such as “save as a favorite”, remain in the Real Estate Portal. The use of these services implies the express authorization of the Real Estate Portal, by the user, to deliver this data to third parties. Obtaining these data justifies the provision of more detailed information, usually reserved for direct care.

9.4.3. Scope of data sent to third parties

In the cases provided for in point 9.4, the data provided by users will be sent by Real Estate Portal exclusively to the company that manages the sale of the development that has been listed and/or those to whom information requests have been sent. The user, by the mere fact of requesting such services, expressly authorizes Real Estate Portal to deliver their personal data to the indicated companies.

9.4.4. Limitation of responsibilities in the use of data by third parties

There is no limitation so that once the data is received, by the corresponding company, it can contact the user. It is expected and probable that the company that manages the sale of the project will contact the user later. However, the contact must fall within the framework to which the company is obliged when contracting the service on the Real Estate Portal. Among other conditions, it is established for the company the obligation to contact the user with the sole purpose of complementing information related to the property, project or product for which the user’s data was sent, or to require his appreciation of it. The company cannot transfer the user’s data to other companies and must be respectful in the contact process so as not to bother the user.

9.5. Limitation of responsibilities by Real Estate Portal

Notwithstanding what is indicated in the previous point, Real Estate Portal cannot guarantee that the data will be used in the correct way and without the possibility of misuse, or that within the agreed use, it will be carried out appropriately. The user who makes use of the service assumes this risk by refusing to report or sue Real Estate Portal for any inconvenience, damage or impairment of their privacy that could have originated from a service with shared data. In particular, it will not be responsible for telephone calls, letters, faxes, e-mails or other communications that do not correspond to those detailed as Real Estate Portal’s own services and that have duly identifying elements of such.

The registered user exempts Real Estate Portal from any responsibility derived from possible interruptions of services, suspensions and interception of personal data, which occur on the network or the Internet site.

9.6. Use of name and password

The Account is personal, unique and non-transferable, and it is forbidden for the same User to register or have more than one Account. In the event that Real Estate Portal detects different Accounts that contain matching or related data, it may cancel, suspend or disable them.

The User will be responsible for all the operations carried out in his Account, since access to it is restricted to the entry and use of his Security Code, of exclusive knowledge of the User. The User undertakes to notify Real Estate Portal immediately and by suitable and reliable means, of any unauthorized use of his Account, as well as the entry by unauthorized third parties to it. It is clarified that the sale, assignment or transfer of the Account under any title is prohibited.

9.7. Benefits for Real Estate Portal, for the use of services for users

Some of the services offered to users, in which there is a presentation of a specific offer of properties or projects, are charged to those who present them, being a sales argument the eventual contact that could be generated with registered users. In this sense, it is noted that although there is no charge to the User, Real Estate Portal obtains or may indirectly obtain an economic benefit from it. Likewise, although strictly keeping the privacy of the Users, it receives or may receive benefits for the statistical information from the records generated by users of the Real Estate Portal. The user acknowledges this right as part of or in compensation for the provision of the service that he obtains, renouncing any action that seeks economic compensation or any other kind.

9.8. Use of information by the User

The information accessed as a registered user may not be used for commercial purposes, including the promotion of any good or service, without the prior authorization of Real Estate Portal. In the event that it is used for non-commercial, journalistic, academic or other purposes, it must be cited as a source.

9.9. Deletion of users

Portal Inmobiliario reserves the right to remove users from the registry or delete their publications from the site, unilaterally, without giving cause, whenever it is verified or suspected that the user is misusing the services of Portal Inmobiliario such as:

  • Include false data.
  • Try to extract unauthorized information.
  • Try to introduce computer virus.
  • Obstruct, restrict or limit the use of the services to other users.

Provide obscene, defamatory or harmful information, including any type of comment, restriction or demand that could be qualified as derogatory, disproportionate, unjustified or discriminatory based on creed, nationality, marital status, gender, origin, social condition, race, sexual orientation or other similar criteria.
Use the services of the site for purposes not permitted by law, morality and good customs.

In general, make a use that may, under different aspects, affect Real Estate Portal, its Clients or other users. Real Estate Portal reserves the right to decide if a certain use deviates from the objective for which the site and the services it provides were created.

Likewise, Portal Inmobiliario may delete users, without prior notice, in order to keep its database updated.

10. Scope, limitations and conditions of services for the Offering Users


The services that the Real Estate Portal offers to its Bidders and Clients Users correspond to all those services linked to the publication of a property offer, such as:

Posting services for used properties.

Publication services for new properties and Real Estate Developments.

10.1. Registration Condition

Any person, either as an individual or on behalf of a legal entity, who wants to publish one or more properties, new and/or used, under any level of service offered by Real Estate Portal, must be registered as a Registered User. Consequently, the Scope, limitations and conditions of services to Registered Users of the Real Estate Portal (Pt. 9), which the Offering user declares to know and accept, will be fully applicable to the Offering User.

10.2. Scope and limitations of Real Estate Portal publication services
10.2.1. Knowledge of Real Estate Portal and Publishing Services

At the time of requesting a publication service, the Bidder declares to know and accept the scope and limitations of the Real Estate Portal; as well as the service or services or the combination of them, requested for the publication of information related to your project(s) and/or property(s).

10.2.2. Affiliated sites and modifications in Real Estate Portal

The Bidder declares to know and accept the possibility of accessing the content of the Real Estate Portal through affiliated sites and recognizes and accepts its dynamic nature, as well as the alternative of permanent evolution. Consequently, there may be changes in the content of the Real Estate Portal, which is not obliged to report them each time they occur, unless they directly involve the content of the information published by the Bidder. If changes are made to the content of the Real Estate Portal, the Bidder may request that the information published by him be removed from the Real Estate Portal.

10.2.3. Classification of published information

The Bidder declares to recognize and accept the Real Estate Portal’s authority to catalog and display the information published by the Bidder under different criteria. This power of classification extends to those descriptive elements, such as, for example, the image of an enclosure, which in isolation could integrate thematic units other than the property of which they constitute a reference and which by itself can be classified in another or other sections. Likewise, Real Estate Portal may classify based on attributes not declared directly by the Offeror based on elements identified in one or more of its images.

Notwithstanding the foregoing, and by written request, the Offeror User may revoke the authorization for use, requesting the removal of the images from the Sections where they were displayed.

10.2.4. Visits and registrations

Real Estate Portal does not guarantee obtaining a minimum number of visits and/or registration of data from potential interested parties in the products offered by the Bidder. Consequently, Real Estate Portal assumes no responsibility for any damages of any nature that could be attributed to the absence of visits or records.

10.2.5. Exclusion of liability for occasional interruptions

Real Estate Portal does not guarantee the absence of incidents, suspensions and interruptions in the network. Consequently, it is exempt from all responsibility for damages of any kind that could be due to possible failures in its operation, which are beyond its control and/or control, and in particular, although not exclusively, that may be due to the Incidents, interruptions or suspensions that occur on the network and on the Internet site that prevent normal user access to the site.

10.3. About published information
10.3.1 Responsibility of the Bidder

The Bidder will be fully responsible for the information published on the Real Estate Portal regarding him/her, the company he/she represents (if applicable) and his/her development(s) and property(s) for sale, whether of a graphic nature , prices or text content.

The Bidder declares to know and accept the responsibility that corresponds to the different components of the information that may be published in the Real Estate Portal, as detailed in the Scope, limitations and conditions of services to visitors of the Real Estate Portal. The Offeror expressly releases and exempts Real Estate Portal from any liability in the event of any claims or demands from third parties, for the publication of unauthorized material or data, erroneous, outdated information, misleading advertising and in general for any concept emanating from the published information or the service. own offered by the Bidder and exposed in the Real Estate Portal.

Portal Inmobiliario will not be responsible for any damages to the Bidder, which may result from the use of data by persons or institutions, for purposes other than those pursued by the Bidder, such as: market research or service offerings. The Bidder declares to know and accept that each data related to its property, or project is available to anyone who can access the Real Estate Portal and that this site does not discriminate or restrict navigation beyond the user registration required for some levels of publication.

10.3.2. Information maintenance and updating

In addition, it will be the responsibility of the Offeror:

The initial review and indication of changes, if applicable, within 48 hours from the activation of the respective service in the Real Estate Portal.

The permanent review of the information presented so that it corresponds to a correct and updated version in order to deliver reliable information to the user of the Real Estate Portal.

Notify Real Estate Portal when changes must be made that cannot be executed directly by the Bidder.

Notify Real Estate Portal of the end of the sales period for a project or property, or end of stock of a product, within a maximum period of five (5) business days after its sale (of the last unit available in the case of developments ).

Report comments or observations in a timely manner, if applicable, each time the Real Estate Portal is notified of changes in the conditions and characteristics of the publication services offered. Real Estate Portal is not obliged to respond to any email or communication received in this regard, or to incorporate the observations, suggestions or comments received.

10.4. Editing guidelines and minimum publication conditions


10.4.1. General editing guideline

Real Estate Portal may delete, edit or modify:

All those contents, published in the Real Estate Portal, regarding which it appears, with evidence or substantiated background, that false information is delivered or in any way misleading or harmful to users.

All those contents, published in the Real Estate Portal, regarding which there are well-founded suspicions or antecedents that allow sustaining that the Offeror is involved in illicit activities, contrary to morality or good customs.

All those contents, published in the Real Estate Portal, with respect to which the Offeror includes any type of comment, information, restriction or requirement that could be classified as derogatory, disproportionate, unjustified, discriminatory (based on creed, nationality, marital status, gender , origin, social status, race, sexual orientation or other similar criteria) or infringes the rights of third parties. All those acts in respect of which citizen organizations or authorities present or threaten to present against the Real Estate Portal or the Offeror any type of action, requirement, or claim, or exercise any type of measure that reasonably could compromise the legitimate interests of the Portal, including statements in the press.

10.4.2. Minimum publication conditions

The Bidder must comply with all the information required by the Real Estate Portal to comply with the minimum data standard required. In the description of the publication it is not allowed to include information related to contact data (phone numbers, email addresses, web pages).

The information in each field of the property file must be similar to the name of the field where it is inserted. Under no circumstances will it be allowed to incorporate advertising content, offers or promotions, except in the sections and/or through services specially designed by Real Estate Portal for this purpose.

Real Estate Portal reserves the right to accept for publication only those requests that, under its own criteria, provide sufficient, orderly information related to the services provided by Real Estate Portal. Real Estate Portal will not publish or may delete information that, in its opinion, is erroneous or that may lead to errors, that may be considered misleading advertising, or any type of information that may be considered contrary to law or good customs.

10.4.3. Text format

Both for projects and properties, the texts cannot be in capital letters and in the case of pre-established publication files, each data that is incorporated must correspond to the title of that cell and not to a different subject.

10.4.4. Use of images
10.4.4.1. Responsibility in the publication

In the case of the images included in the presentation of a property, and especially of a development, the Bidder assures in the very act of requesting or contracting the service to Real Estate Portal, that it has the respective permissions or rights of publication, reproduction , adaptation and distribution of images. Therefore, the Offeror acknowledges his absolute responsibility for the publication of each of the images related to what is offered. Real Estate Portal does not assume any responsibility towards third parties in the event that the publication of the images on the site does not have the corresponding authorization.

10.4.4.2. Reproduction and adaptation license on images

The Offeror authorizes Real Estate Portal to reproduce, publicly communicate, adapt and distribute the images. Consequently, he expressly acknowledges the faculty of Real Estate Portal to adapt or modify the images, becoming the owner of the adapted images. 10.4.4.3. Image Playback

The reproduction or cloning of images without authorization corresponds to an improper appropriation that violates the good practices that Portal Inmobiliario seeks to promote. However, it is not part of the service offered by Real Estate Portal, to investigate and pronounce on the veracity and authorship of an image. Consequently, the bidder may report to the competent authorities and/or courts what in his opinion corresponds to the copy of a certain image, but waives the demand for its removal, and any other action by Real Estate Portal, including a response to his request. complaint. However, Real Estate Portal, due to good service and in favor of good practices, as the circumstances warrant, may delete images that it reasonably interprets as replicas and, depending on the seriousness of the case, delete the publication of the property, or, even, of the set of properties published by the Bidder. It is noted that, in fulfilling this purpose, given the difficulty inherent in classifying an image as cloned and the possible use of automated or semi-automated processes, Real Estate Portal may mistakenly eliminate any image that turns out to be original. The Offeror acknowledges this eventuality as a risk of the service and accepts that its occurrence as devoid of any value imputation intention on the part of Real Estate Portal, which could implicitly be interpreted by the elimination of the image.

10.4.4.4. Power to object images by Real Estate Portal

In the event that the images that are incorporated do not correspond, in the opinion of the Real Estate Portal editor, to the character defined for the space in which they are inserted, are of poor quality, generic and may be representative of other properties, of more than one property or developments different, represent objects constructive details of common use not descriptive of the particularities of the property or its spaces, there were reasonable presumptions to be considered copies of other images already published, or that for any other reason do not meet the quality standards defined by Real Estate Portal, may be removed by it, without prior notice.

Images of developments and properties where children and real people appear, who can be easily identified in their features for having an important presence in the image, may also be eliminated. Likewise, juxtapositions or sequences of images that occupy the format defined for only one of them (animated GIFs) may be eliminated. Also images with graphic effects that in some way could mean appreciation problems.

The Offeror expressly authorizes Real Estate Portal to eliminate images that incorporate logos, texts, identification codes, or any other type of distinctive, or to eliminate said distinctive, to the extent that this is possible, by means of a graphic intervention, without the need for notice. before or after.

In the event that an image removal means an undermining of the publication standard, Real Estate Portal may put an end to the publication of all the information referring to the development or property. Likewise, if there is a recurrence in publishing previously objected images.

10.4.5. Power to object images by Real Estate Portal

The publication of videos, animations, speeches or sound pieces, is subject to the review and prior approval of Real Estate Portal. Real Estate Portal is not obliged, under any circumstances, to publish them, nor to provide the reasons for a negative decision to publish them. In case of publication, the Bidder expressly authorizes Real Estate Portal to reprocess, edit and omit the sound component. The Bidder will be exclusively responsible for having the due rights and/or authorizations to make use of the videos, animations, speeches, sound pieces or any other graphic, sound or any other material that it wishes to use in the respective publication. By signing and accepting these “Scopes, limitations and conditions of services to offerers of the Real Estate Portal”, the Offeror acknowledges being exclusively responsible for the content of its publication, and undertakes that it will not violate intellectual property rights or any other nature belonging to third parties. In the event of any action that third parties may bring against the Real Estate Portal, who claim to have been affected in their intellectual property rights, or of any other nature, due to an unauthorized display or use, the Bidder undertakes to mediate so that the claimant desists from his complaint or lawsuit, and in the event that this action fails, fully indemnifying Portal Inmobiliario for all damages that said complaint or lawsuit could mean. As long as the conflict is not resolved, Portal Inmobiliario may delete the questioned publication.

10.4.6. Use of logos and images alluding to the company

The use of logos, isotypes and representative images of the bidder is strictly subject to certain spaces within the Real Estate Portal and formats previously defined in it. The Bidder expressly authorizes Real Estate Portal to eliminate any isotype or logo that Real Estate Portal considers to be a design or modification made expressly to obtain any advantage not agreed upon in the publication on Real Estate Portal, or that due to the characteristics of its design or format represent a detriment to the standard of presentation or the content of the site. The Offeror expressly authorizes Real Estate Portal to disable the publication of a logo or image allusive to the Offeror, at any time, without expression of cause.

10.5. Publishing restrictions
10.5.1. Publication of rented or sold properties

Under no circumstance may a development or property that is advertised as “sold” or “rented” be published or remain in publication. Real Estate Portal reserves the right to immediately withdraw the project or property that indicates a status that indicates that it is not available or, without indicating it, there is evidence that they are sold or rented even when they could be representative of other properties or developments of the Offeror. 

10.5.2. Reference to other websites


Unless there is a prior and explicit agreement as part of a complementary service agreed with Real Estate Portal, an address may not be published as part of the images of what is offered, in the descriptive information thereof, or in the seller’s contact information. web or element that alludes to it. Specifically, you will not be able to put the name of the company or any web address in the address or sector field. In the event that this occurs, Real Estate Portal may omit the publication of the property, or development, or eliminate the web address, or the element that refers to it, without prior notice to the offeror. Conversely, the information published at the request of Real Estate Portal tools cannot be used by the Bidder on other sites through non-agreed links.

10.5.3. Double listing as used property (individual) and as development

A property that is one of several units of a new development for sale, can only be published in the Real Estate Portal, under one of the two alternatives: as a development, or as an individual property. In the latter case, only one of each type may be published. If there is more than one, Real Estate Portal may maintain one and eliminate the others without prior notice.

10.6. About the data obtained by the Offeror
10.6.1. Veracity and quality of data obtained

Portal Inmobiliario does not assume, before the Bidder, any responsibility, when providing the service of publication of developments or properties on the Internet, regarding the veracity or quality of the information that it obtains through Portal Inmobiliario.

10.6.2. Proper handling of data obtained

In case of having services or functionalities that allow the reception of data from users of the Real Estate Portal, the Bidder undertakes to maintain strict reserve and confidentiality of them. The records may only be used to be contacted for purposes related to the sale of development units, or the property under which they were generated. The Bidder is obliged not to use data generated by a development for sale purposes of a different one, be it his own or a third party’s. Likewise, the Offeror undertakes that, in the event of monitoring, either by itself or through the contracting of an external service, it will carry out said practices with due respect, trying not to bother the registered user, affecting their privacy. or contrary to their willingness not to continue receiving communications from the Offeror.

10.7. Use of property data to generate statistical information

The Bidder declares to know and accept that the data provided to the Real Estate Portal may be used by it to generate general offer statistics that it may freely market. As well as statistics related to the demand based on the queries and visits made to the development. However, Portal Inmobiliario will not deliver, as part of these statistics, development values ​​that imply antecedents or an elaboration beyond that published in Portal Inmobiliario, accessible by any visitor to the site.

10.8. Associated products and services

The Bidder declares to know and accept that Real Estate Portal may offer products and services associated with real estate, mortgage and home equipment, accessible from real estate offer information, within which a property of the Bidder could be found. Real Estate Portal may freely include, modify and eliminate this offer without the need to notify the Offeror in advance and without the latter being able to object to its publication.

In any case, the presentation format is made in such a way as to respect the independence of the property with respect to the product offered and in a context whose dynamism and quality of the resource should represent a benefit for the Bidder.

10.9. Associated products and services

The publication term for each property, not included in a paid publication package, will be that indicated by each type of publication in particular. The Bidder expressly authorizes Real Estate Portal to extend said period without prior notice. The Bidder may extend the initial term for one or more periods following the instructions indicated for this purpose, as long as this option is presented as available as reported directly on the Real Estate Portal. It is hereby stated that Portal Inmobiliario is not obliged to grant extensions to the initial period or to warn by email dates of terms. The Bidder expressly authorizes Real Estate Portal to modify without prior notice the publication term indicated in the publication process, terms that will govern from the date on which these Scopes, limitations and conditions of services to Real Estate Portal Bidders are modified and published. . Consequently, it will be the exclusive responsibility of the Bidder to find out about the publication deadlines and periodically review the publication status of their property(ies) in the Real Estate Portal. The Bidder renounces any action of complaint, complaint or claim of any other nature, against Real Estate Portal regarding the suspension of any publication, whether it is pre-established or not, and whether or not it has been previously notified.

Similarly, he waives any action or claim against Real Estate Portal if, on the contrary, as a result of a property(s) being published, the Bidder and/or a third party are affected in any way by said publication. 10.11. Power to terminate the publication by Real Estate Portal

Notwithstanding what is indicated in Point 10.9, regarding the publication period, the Bidder expressly authorizes Real Estate Portal to suspend in advance and unilaterally, temporarily or indefinitely, the publication of a property, a portfolio of them or a development.

Given the complexity and dynamism inherent to the Real Estate Portal, and the heterogeneity of those who intervene in it and their interests, which makes it impossible to preempt or all the situations that could affect the parties involved, this power is not limited to being used as an extreme measure. in the event of a flagrant violation of one or more of the publication conditions set forth herein, and may be made effective whenever Real Estate Portal deems it necessary or convenient to safeguard its own interests, those of Real Estate Portal users or their clients. In view of this fact, Real Estate Portal will not be obliged to express the reasons why it terminates the publication in advance, sufficing in the respective notification to cite this article as justification of the power that assists it to make it effective.

In any case, Real Estate Portal undertakes that, if there have been payments for publication concepts, the service is suspended within a period that fully covers what was paid in advance, or the corresponding money is returned.

Terms and Conditions Specific to Paid Posts / Featured Classifieds

The rules for using our paid posting / featured classifieds service are included in and form part of our Terms and Conditions of Use.

After the purchase of a paid publication / featured classified, Portal Inmobiliario will send the user an email with the confirmation and the number of the receipt.
It will be the responsibility of the User to publish the classified as soon as possible. If for any reason, technical or otherwise, the listing does not appear within 24 hours of purchase, please contact our customer service team, including the listing ID. It is important to take into account that any advertisement that is not legal or does not comply with our Terms and Conditions of Use will be deleted, without the right to return or refund.
It is not allowed to publish similar or duplicate advertisements (example: repeated advertisements of the same object or service in the same category). Any advertisement that does not comply with the rules of the Real Estate Portal Publication Policy or the Terms and Conditions of Use will be eliminated, without the right to return or refund.
In the case of the featured classified, it will be featured for as long as it is selected by the user. If it is deleted or deactivated before the subscription expires, it will not be possible to reactivate the remaining days and the user will not be entitled to a return or refund for those days.
The user must ensure that he selects the appropriate category for his classified. If it is published in an incorrect category, the classified will be eliminated and will not be entitled to return or refund.
The user understands that if the item in the featured ad is sold before the end of the term, the user will not be able to change the posted ad for another ad. The featured classified is unique to the ad used from the featured post.
The classifieds related to the Personal categories that are published in another category will be eliminated without the right to return or reimbursement.
The classifieds that are considered offensive, pornographic, spam, fraud or that do not comply with the rules of the Publication Regulations of the Real Estate Portal or the Terms and Conditions of Use, will not be published under any circumstances and will be eliminated, without the right to return or reimbursement. .
Real Estate Portal reserves the right to modify or eliminate the content of any classified that does not comply with the rules of the Real Estate Portal Publication Regulations or with the Terms and Conditions of Use, without the right to return or reimbursement.
The personal data that the User provides in relation to the Featured Classifieds will be treated in accordance with the provisions of the Privacy Policy.

11. Scope, limitations and conditions of services for Customer Users

These conditions correspond to an extension of those established for the Offering Users, incorporating those additional aspects that arise with the commercial relationship in which a payment to the Real Estate Portal is agreed, by which the Offering User is renamed the client user (hereinafter, “Client User” or “Client”). Consequently, the Scope, Limitations and Conditions of Services for the Offering Users of the Real Estate Portal (Pto. 10) are an integral part of these general conditions of publication services.

11.1. Deadlines
11.1.1. For real estate development publishing services

They are established for each development, regardless of whether the same Client can publish more than one development. It is considered a single fixed-term option, which implies the period between the activation of the plan until a fixed date established for the duration of the contracted package. By default, there will be indefinite rehiring, in case something else is not specified. In this way, the term will be extended automatically and successively until the Client indicates otherwise, canceling the service.

11.1.2. For property listing services

The publication deadlines will be governed according to what is specified in the respective plan contract.

11.2. Prices

The price will correspond to that established according to the current rate for the service on the date of request and will remain unchanged during the period agreed between the Client and Real Estate Portal for its provision.

There are no discounts for partial use of the resources available for each service.

The request for the end of the service before the end of the period established at the time of contracting will not give the right to reimbursement or replacement for another property or project, corresponding to the payment of the full term.

11.3. Publishing Software

For those Real Estate Portal services that specifically include or require the use of a software or publication or editing tool, Real Estate Portal is not responsible for and does not guarantee the compatibility of the software with the client’s technological platform. Real Estate Portal is not obliged to develop or deliver new versions of the software.

The Client, if applicable, may extend the use of the software: during the validity of the contracted service with Real Estate Portal to all its functionalities not directly related to the publication in Real Estate Portal, whose scope and limitations the Client declares to know and accept, except for publication on other Internet sites.

Under no circumstances may the Client:

Interfere with the software, or facilitate third parties to do so.

Copy it totally or partially.

Use the software for any type of publication on another internet site(s), other than Real Estate Portal.

The Portal reserves the right to modify at any time and without giving cause, the characteristics, tools or functionalities of the publishing software. So you can also update it by releasing new versions.

The Client will be responsible and will assume the possible costs of:

Recover from the software the information that you would like to retain regarding the management of the property portfolio.

The client expressly releases and exempts Real Estate Portal from all liability for damages that may result in this process and that are not attributable to their negligence.

11.4. System backups and your information

Although periodic backups of the system and its data are made, in order to be able to recover all its functionalities prior to some catastrophic event, it will be the Client’s responsibility to maintain backups of their data and information published on the Real Estate Portal. Consistent with the foregoing, Real Estate Portal does not assume any obligation to store or support the data, content and images of historical information.

The following documents and/or sections of the Real Estate Portal incorporated by reference, where policies and/or terms and conditions of different services offered on the site are detailed, are an integral and inseparable part of the General Terms and Conditions. 13. Jurisdiction and Applicable Law

This agreement will be governed in all its points by the laws in force in the Mexican Republic, in particular regarding data messages, electronic contracting and electronic commerce will be governed by the provisions of the respective federal legislation.

Any controversy derived from this agreement, its existence, validity, interpretation, scope or fulfillment, will be submitted to the applicable laws and to the competent Courts.

For the interpretation, fulfillment and execution of this contract, the parties expressly submit to the jurisdiction of the competent courts of the City of Mérida, Yucatán, consequently renouncing any jurisdiction that may correspond to them due to their present or future domicile.
